Claim For Sexual Orientation Discrimination Not Viable In Court
Although Kentucky state law does not prohibit sexual orientation discrimination, such a prohibition does exist in Jefferson County pursuant to Louisville-Jefferson County Metro Government Ordinance Chapter 92(the "Ordinance").
Recently in Roberson v. Brightpoint Services, LLC, a federal court in Louisville held that a claim for sexual orientation discrimination may not be pursued in court. The proper forum for relief would be an administrative action before the Louisville Jefferson County Human Relations Commission. The court also held that there is no Kentucky state policy against sexual orientation discrimination, and therefore a generic wrongful termination claim can not be premised on such discrimination.
