EEOC Signals Close Scrutiny of Employers' Commercial Driver's License Requirements
The EEOC has challenged as unlawful an employer's policy obligating its delivery truck drivers to pass the DOT's standard medical exam.
In litigation filed against Kalil Bottling Company, the agency alleges that the DOT physical is not "job-related" and "consistent with business necessity" because the Company applied the requirement to a driver who allegedly drives a personal truck not heavy enough to mandate a commercial drivers license (CDL). The EEOC asserts that the Company's medical examination policy "tends to screen out individuals with disabilities, including diabetes."
