Ohio Supreme Court Accepts Two Employment Cases
Earlier today, the Ohio Supreme Court accepted two important employment-related cases.
The first case, Zajc v. Hycomp, Inc. will require the court to address Ohio’s common law claim of wrongful termination in violation of public policy. The plaintiff in Zajc alleged that he had been discharged for refusing to ship defective parts to a customer, while his employer asserted other reasons for the discharge. At issue in the case is whether the sources of public policy identified by the plaintiff are sufficient to state a claim. The link to the court of appeals decision is here.
The second case is Tenney v. General Electric Co. In Tenney, the court of appeals ruled that the plaintiff could assert a claim for harassment based on sexual orientation through a common law claim of intentional infliction of emotional distress. The defendant appealed to the Court on several grounds, but the Court accepted the appeal only on the issue of whether the statute of limitations for assault and battery applies to the claims, or the longer statute of limitations for intentional infliction of emotional distress.
