Wellness Program Checklist

The Health Insurance Portability and Accountability Act ("HIPPA") generally prohibits a group health plan or group health insurance issuer from charging an individual a higher premium than a similarly situated individual based on a health factor such as health status, genetic information, or medical history.  

However, a plan may vary benefits based on whether an individual meets the standards of a "wellness program" that complies with 29 C.F.R. § 2590.702(f).  The Department of Labor recently issued a checklist to help employers determine if they offer a health promotion or disease prevention program that must comply with these regulations, and, if so, whether the program is in compliance.
